HIGH COURT OF ANDHRA PRADESH AT AMARAVATHI
MAIN CASE: W.P. No. 28685 of 2026
PROCEEDING SHEET
1. Notice Before Admission
Notice before admission, returnable in four (4) weeks.
2. Subject of the Writ Petition
The present Writ Petition is filed questioning the qualification marks prescribed under Notification No. 1-APSPL-TET-August-2026, dated 24.08.2026, as illegal and arbitrary.
3. Special APTET–August 2026: Pass Criteria
Clause 13 of the notification prescribes the following pass criteria:
| Community | Pass Marks |
|---|---|
| General / EWS | 60% and above |
| BC | 50% and above |
| SC / ST / PWBD & Ex-Servicemen | 40% and above |
4. Submissions on Behalf of the Petitioners
Sri K.S. Murthy, learned Senior Counsel for the Petitioners, submitted that the syllabus prescribed for the TET examinations runs contrary to the guidelines provided by the NCTE for conducting the Teachers Eligibility Test.
It was further submitted that a distinction should be made between TET conducted for recruitment and TET conducted to enable existing teachers—appointed in various schools across the State before enactment of the NCTE Act and the Right to Education Act, 2005—to qualify. According to the submission, the qualifying marks need to be adjusted to enable these existing teachers to qualify.
5. Submission on Behalf of the Respondents
The learned Government Pleader for Services-III submitted that, under NCTE guidelines, a person securing 60% and above in TET is considered qualified, with concessions for SC/ST/PWBD and Ex-Servicemen, etc., in accordance with the applicable reservation policy.
It was submitted that the notification provides different qualifying marks for different social categories.
6. Court's Observation
The Court observed that there is merit in the contention concerning identical qualifying marks for entrant teachers and long-standing teachers with over 15 to 20 years of experience.
However, the Court stated that its scope to determine those aspects and fix qualifying marks is limited, and that the matter is for the concerned authorities to consider. The issue of the test syllabus may also be considered by the authorities concerned.
7. Interim Direction
The Respondents shall consider the representations of the Petitioners dated 01.09.2026 and 28.09.2026 at the earliest, preferably within a period of three (3) weeks from 09.10.2026.
8. Next Hearing
The case is posted to 06.11.2026 to enable counsel for the Respondents to file a Counter-Affidavit.
