LEAVE RULES IN ENGLISH


A.P. Leave Rules – 1933

General Rules & Concepts

  • Definition & Sanction: Leave is not a right. To be valid, it must be properly sanctioned, with proper relief and a proper handing over of charge. Employees can be recalled from leave, and a physical fitness certificate is required upon return.
  • Duty Periods: Duty periods include Casual Leave, public holidays, leave periods before/after holidays (prefix/suffix), vacation periods, foreign service, joining time, and sanctioned leave.
  • Restrictions: No employment is permitted during leave. No leave will be sanctioned to a suspended employee.
  • Recasting Leave Accounts: When a temporary government servant is later placed on probation with retrospective effect, their leave account must be recast from the date of service regularization.

Kinds of Leave

1. Casual Leave (C.L.)

  • A concession to allow government servants to be absent from duty for short periods due to special circumstances.
  • It is treated as duty.
  • The maximum period for availment in a calendar year is generally 15 days, and the continuous period of absence should not exceed 10 days.
  • Unavailed leave lapses at the end of the calendar year. It can be combined with optional and public holidays.
  • Half-day C.L. is permitted either from 10:30 A.M. to 1:30 P.M. or from 2:00 P.M. to 5:00 P.M.. A mandatory register must be maintained.

2. Special Casual Leave

  • Blood Donation: 1 day is granted for donating blood.
  • Court Witness: Granted as per the attendance certificate if summoned to give witness in a court where private interest is not an issue.
  • Family Planning:
    • Male (Vasectomy): 6 working days for the 1st and 2nd operations.
    • Female (Tubectomy): 14 working days for the 1st and 2nd operations.
    • Male (Wife's Tubectomy): 7 days for the 1st and 2nd operations.
    • Contraceptive Insertion: 1 day.
    • Recanalisation: 21 days for both males and females.
  • Sports & Associations:
    • Up to 30 days for participating in sporting events; excess is treated as regular leave.
    • Principal office-bearers of recognized service associations receive 21 days in a calendar year.
    • 10 days for participating in AP Bharat Scouts and Guides rallies/camps.
    • 15 days per calendar year if elected as President or Secretary of National Sports bodies.
  • Cultural & Engineering Institutions:
    • AP Secretariat Cultural Association members get 6 days per calendar year for dramas.
    • Members of the Institution of Engineers get 7 days for attending the annual meeting in Hyderabad and 10 days for national conventions.

3. Earned Leave (E.L.)

  • All temporary and permanent employees earn leave for duty and leave periods. Credit is calculated based on completed months, ignoring fractions.
  • Leave is credited in advance in two spells (January 1st and July 1st). Permanent employees receive 15 days per half-year (earning 2 ½ days per completed month), while temporary employees receive 8 days per half-year.
  • Advance credit is reduced by 1/10th of any Extra Ordinary Leave (EOL) taken during the preceding half-year, up to a maximum reduction of 15 days for permanent or 8 days for temporary staff.
  • The maximum accumulation allowed is 300 days. The maximum leave that can be availed at a single time is 180 days.
  • Employees taking at least 30 days of E.L. can surrender up to 30 days for leave salary. Surrender intervals are 24 months for a 30-day surrender and 12 months for a 15-day surrender. Employees can encash up to 300 days of E.L. at superannuation or death.

4. Half Pay Leave (H.P.L.)

  • Regular government servants receive 20 days for each completed year of service, credited for duty, leave, and EOL.
  • Granted on a medical certificate or for private affairs, with no limit on sanctioning H.P.L..
  • Regular employees suffering from severe diseases (e.g., Cancer, Heart diseases, Leprosy, TB, Mental illness, Renal failure) can be granted H.P.L. on full pay for up to 6 or 8 months depending on specific orders.

5. Commuted Leave

  • Granted only on a Medical Certificate.
  • Twice the amount of commuted leave taken is decoded/deducted from the H.P.L. account.
  • Limited to 240 days during the entire service period.

6. Leave Not Due

  • Granted on a Medical Certificate only when there is no balance of H.P.L. or E.L.. It is limited to the H.P.L. the employee is likely to earn in the future.
  • The maximum limit for availment is 180 days during the entire service.
  • If an employee resigns or retires voluntarily before adjusting the minus balance, the paid leave salary is recovered; recovery is waived in cases of death or medical invalidation.

7. Extra Ordinary Leave (E.O.L.)

  • Granted when no other leave is available, or when an employee requests it in writing.
  • For permanent employees, the maximum period of absence of any kind on leave is 5 years. For non-permanent employees, E.O.L. generally cannot exceed 3 months, though it extends to 6 months with a medical certificate (if having 3 years of service), 18 months for T.B./Leprosy treatment, and up to 24 months for SC/ST employees prosecuting studies.
  • E.O.L. on medical certificates counts toward qualifying service for increments up to 6 months by HOD permission, or longer with Government competency.

8. Special Disability Leave

  • Given to permanent or temporary employees disabled by injury caused during or in consequence of the due performance of official duties.
  • The leave cannot exceed 24 months. It requires a certificate from a Medical Board for Gazetted Officers, a Civil Surgeon for N.G.Os, or a Government Medical Officer if the leave does not exceed 2 months.
  • It counts as duty for pension calculations and is not debited against the regular leave account.

9. Study Leave

  • Granted strictly by the Government for scientific or technical studies that benefit the department. Employees with less than 5 years of service or those retiring within 3 years are ineligible.
  • Cannot exceed 2 years in entire service, or 28 months if combined with other leaves with allowances.
  • The employee draws a leave salary equal to half pay, and the leave is not debited against the regular leave account.

10. Maternity Leave

  • Admissible to married female government servants for up to 180 days per confinement. It is not granted if the employee already has two living children.
  • In case of miscarriage or abortion, leave is limited to a maximum of 6 weeks.
  • Leave salary is equal to full pay, and the period is not debited against the leave account.

11. Hospital Leave

  • Applicable to all last grade employees; temporary employees are not eligible.
  • Should not exceed 6 months in every 3 years of service, and the leave salary is equal to half-pay leave salary.

12. Paternity Leave

  • Granted to married permanent or temporary male government employees who have one surviving child.
  • Granted for a period of 15 days on full pay.

13. Leave for Employment Abroad

  • Technical and non-technical categories of employees are eligible for a 5-year EOL.
  • It can only be sanctioned after receiving an official appointment letter; leave cannot be granted to search for a job. It is allowed only once in an entire service history, and permission must be secured before joining.
  • It is not treated as a service break, but failure to rejoin duty after the leave expires is treated as a cessation of employment.
